§ 1 Scope of application
(1) These terms and conditions apply to the participation of third parties (participants) in competitions run by QUARTERBACK Immobilien ARENA (ZSL Betreibergesellschaft mbH) –Am Sportforum 2, 04105 Leipzig. QUARTERBACK Immobilien ARENA is the operator of the Facebook page https://www.facebook.com/ARENALEIPZIG/ (operator). They apply in addition to any special conditions of participation, if and to the extent that such conditions have been announced for the respective competition. All participants accept these conditions of participation by participating.
(2) Participation in competitions is free of charge and without obligation for participants.
(3) Please also note our information on data protection.
§ 2 General
The competitions organized by QUARTERBACK Immobilien ARENA are in no way connected to Facebook and are not supported by Facebook.
§ 3 Eligibility
(1) Each participant may only enter the prize draw once per competition. Participants must be of legal age and have a valid postal address in Germany as well as permanent residence in Germany. Persons under the age of 18 require the consent of their legal guardian to participate in the competition. Minors may only accept the prize with the written consent of their legal guardian.
(2) Legal representatives, employees, dealers, and partners of QUARTERBACK Immobilien ARENA, as well as all persons involved in the creation and implementation of the competition, and the family members of the aforementioned persons, are excluded from participating in the competition.
(3) Participation with fake identities or with the identities of third parties is not permitted.
§ 4 Conditions of participation
(1) Participants undertake not to share any illegal, racist, violence-glorifying, sexist, or homophobic content.
(2) Participants agree that their submitted photos or images may be published on Facebook and elsewhere. By submitting their entry, each participant grants QUARTERBACK Immobilien ARENA ownership and comprehensive rights of use and exploitation of the submitted material, unless the participant declares their objection in writing. QUARTERBACK Immobilien ARENA accepts no liability for any material submitted. If participation requires the submission of materials or files, each participant warrants that they are the sole owner and holder of all rights of use and exploitation of the submitted material.(3) Participation in the competition takes place via the comment function. All participants must enter the correct answer to the respective competition question or post the desired material (e.g., pictures or similar) in order to take part in the prize draw in which the winners are determined. Multiple comments or submissions will be counted as a single entry. Comments that violate Facebook guidelines, German law, and/or copyright will be removed without notice upon discovery. The participant will then be excluded from the prize draw. Legal recourse is excluded.
(4) Participation is free of charge.
§ 5 Participation period
The individual participation periods can be found in the prize draw..
§ 6 Prize processing, draw, and notification
(1) The winner will be determined from among all legitimate participants in the competition.
(2) Participants agree to be notified of their prize in writing or by email when the prize is sent.
(3) The operator reserves the right to publish the winner's Facebook name on the Facebook page.
§ 7 Delivery of prizes(1) The winner must confirm receipt of the prize notification immediately, but no later than 7 days after notification by QUARTERBACK Immobilien ARENA, by sending a personal Facebook message to QUARTERBACK Immobilien ARENA and providing contact details for the delivery of the prize. Otherwise, a new winner will be selected from among the remaining participants.
(2) If the prize cannot be delivered, the operator reserves the right to select a new winner.
(3) If the contact details provided are incorrect (e.g., postal or email addresses), the operator is not obliged to search for the correct address. Any disadvantages resulting from the provision of incorrect contact details (e.g., incorrect postal or email address) shall be borne by the participant.
(4) The participant's data will be collected exclusively for the purpose of conducting the competition and will be deleted afterwards. No further transfer of personal data to third parties will take place.
§ 8 Liability(1) The operator shall be liable in accordance with the statutory provisions, unless otherwise specified below.
(2) The operator shall be liable without limitation for damages resulting from injury to life, limb, or health.
(3) The operator shall be liable, limited to compensation for foreseeable damage, for such damage resulting from a slightly negligent breach of essential (so-called cardinal) contractual obligations.
(4) Furthermore, the operator shall only be liable in cases of gross negligence or intent.
(5) The operator is not liable for legal violations of any kind by participants.
§ 9 Early termination of the competition
(1) The operator reserves the right to terminate or interrupt the competition or prize draw at any time without prior notice for good cause. This applies in particular to reasons that would disrupt or prevent the competition or prize draw from running as planned. If such termination is caused by the behavior of a participant, the operator is entitled to demand compensation from that person for the damage incurred.
(2) Furthermore, QUARTERBACK Immobilien ARENA reserves the right to exclude a participant from participating in the competition and/or to refuse to hand over the prize and to reclaim a prize that has already been handed over if the participant violates these conditions of participation.
(3) QUARTERBACK Immobilien ARENA reserves the right to exclude individuals from participating in the competition for justified reasons, even retrospectively. Justified reasons include, for example, a violation of these conditions of participation, incorrect or illegal information, or any kind of manipulation or unlawful influence on the competition.
(4) Cash payment or transfer of the prize is not possible. Legal recourse is excluded.
§ 10 Final provisions
(1) Should individual provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected. They shall be replaced by an appropriate provision that most closely corresponds to the purpose of the invalid provision.
(2) Legal recourse is excluded.
(3) The competition is subject exclusively to the laws of the Federal Republic of Germany.
